Opposition Proceeding
Definition:
A proceeding before the Trademark Trial and Appeal Board in which the plaintiff seeks to prevent the issuance of a registration of a mark.
Change Of Name
Definition:
Owners of trademark applications and registrations change their names, even though the actual ownership of the application or registration has not been transferred.
Demand
Definition:
Form PCT/IPEA/401, filed with an International Preliminary Examining Authority, demanding that an international application shall be the subject of an international preliminary examination.
Fanciful Marks
Definition:
Comprise terms that have been invented for the sole purpose of functioning as a trademark or service mark.
Ordinary Skill in the Art
Definition:
That level of technical knowledge, experience, and expertise possessed by the run-of-the-mill or ordinary engineer, scientist, or designer in the technology that is relevant to the invention.
